1. SCOPE OF APPLICATION / GENERAL

matt-elly.com is the online store of Matt & Elly AG, Erlenmattstrasse 93, 4058 Basel. The offer of matt-elly.com is aimed at private households in Switzerland.

Pickup or delivery (shipping costs from CHF 5 per delivery)

We deliver directly or by mail from Monday to Saturday throughout Switzerland. We deliver to all Swiss regions. The purchase contract is entered into with Matt & Elly AG.

Delivery takes place within a maximum of five working days.

The online product offers are only valid as long as they are visible in the online store and while stocks last. The images shown in the online store are for illustration purposes only and are non-binding.

These General Terms and Conditions (hereinafter referred to as GTC) apply to all services provided by matt-elly.com.

2. REGISTRATION AND ORDERING OF GOODS

2.1. Registration

Registration with the online store is reserved exclusively for persons with legal capacity. It is free of charge. There is no entitlement to admission to the online store. The data required for registration are to be provided by customers completely and truthfully and customers are responsible for updating the data themselves.

2.2 Order Placement / Conclusion of Contract

Orders are placed exclusively online via the Internet order page.

The customer’s orders are confirmed by e-mail. A contract between customer and Matt & Elly AG is only concluded with this confirmation of the order. Matt & Elly AG is free not to accept an order – for whatever reason – and to refuse its confirmation.

Customer:in confirms with the order the correctness of all given information.

2.3 Minimum order value

There is no minimum order value. The cost per delivery is at least CHF 5.-, VAT included.

2.4 Right of withdrawal / changes and cancellation of orders

Subsequent changes to orders that have already been confirmed are not possible.

3. DELIVERY

3.1 Delivery of goods

Goods are delivered directly to the delivery address and contact person provided by the customer or are picked up by the customer at our location at Erlenmattstrasse 93.

Depending on the assortment and place of delivery, the delivery will be made by Matt & Elly AG itself or by Die Post. The delivery will be made as far as accessible to the place of delivery indicated in the order for private persons within Switzerland.

3.2 Delivery times and compliance with delivery deadlines

Matt & Elly AG and the delivery partners:in do their utmost to meet the delivery times. However, all delivery times announced by Matt & Elly AG serve only as orientation. Non-compliance with the delivery times does not entitle the customer to withdraw from the contract or to claim damages. In case Matt & Elly AG or the delivery partners should not be able to deliver an order confirmed by Matt & Elly AG in full or in part, no claim for damages arises. The value of the undelivered goods will be refunded.

3.3 Delivery fees

Deliveries are based on the delivery quantity and cost at least CHF 5.- per order. The cost will be calculated before payment.

3.4 Delivery in the absence of the customer

For quality and safety reasons, Matt & Elly AG endeavors to hand over the delivery of goods personally to customers. If a personal handover is not possible during the agreed delivery time, the goods will be deposited in the mailbox.

With the handover of the goods, respectively the deposit of the goods in the mailbox, benefit and risk, especially the risk of theft, damages by third parties and environmental influences are transferred to the customer.

3.5 Empties and deposit

Glass bottles without deposit, aluminum cans and packaging cartons must be disposed of by the customers themselves.

3.6 Complaints and returns

The inspection of the delivered goods is the responsibility of the customer. Defects must be reported to the delivery partner immediately upon receipt of the goods. Otherwise the delivery is considered as faultless and accepted by the customer. Hidden defects have to be complained to Matt & Elly immediately after their discovery.

Mistakenly delivered beverages accepted by the customers do not have to be taken back by Matt & Elly AG.

Products which customers have ordered by mistake will neither be taken back nor refunded.

3.7 Cancellation of the delivery by Matt & Elly AG

If the successful delivery is not possible or only possible under difficult circumstances due to reasons Matt & Elly AG is not responsible for, e.g. wrong delivery address, absence of the recipient without consent to deposit the goods in front of the door, missing minimum age of the recipient of the goods, missing access permission, bad weather or traffic conditions etc., Matt & Elly AG is entitled to cancel the order. Any claim of the customer for damages or real compensation is fully excluded in this case.

4. PRICES AND PAYMENT

Matt & Elly AG reserves the right to change assortment and prices at any time. Promotional prices and special offer prices offered on Matt & Elly AG are only valid for the online store on matt-elly.com and only if explicitly mentioned.

4.1. pricing conditions

All prices are in Swiss francs, including applicable value added tax. The prices as displayed on the Internet site at https://matt-elly.com at the time of the order shall apply.

4.2 Payment methods

For payment, different methods of payment are available, whereas Matt & Elly AG is entitled in each case to decide at its own discretion which means of payment will be accepted in the respective concrete individual case. 

5. PRODUCT DECLARATION

5.1 Product information

The product information published in the online store is updated regularly and with the utmost care. In exceptional cases, this information may differ from the information actually printed on the packaging. In this case, the information on the package is always decisive. Since recipes can be changed at any time, it is recommended to regularly consult the list of ingredients on the packaging and to pay attention to the allergy notice.

6. PROTECTION OF MINORS

At Matt & Elly AG no beer or wine is sold or given to young people under 16 years. With the indication of the date of birth, the customer:in bindingly indicates his age, so that this regulation and the legal regulations can be observed. Delivery partners:in of Matt & Elly AG reserve the right to carry out an age check before handing over or delivering the goods.

7. GUARANTEE OF DATA COMMUNICATION

Data communication via the internet cannot be guaranteed to be error-free and/or available at all times according to the current state of the art. Matt & Elly AG is therefore neither liable for the constant and uninterrupted availability of the online store nor for technical and electronic errors during a sales transaction, in particular not for the delayed processing or acceptance of orders.

8. DISCOUNTS, BENEFITS & VOUCHERS

8.1. discounts

Accumulation of discounts or of discounts and promotions is not possible. Spirits and personalizable items are excluded. Further exclusions of products are reserved to Matt & Elly AG for each discount promotion.

8.2. promotions

The promotions offered at matt-elly.com may be limited to certain delivery areas and are valid while stocks last. For promotions, the quantity that can be ordered per purchase may be limited.

8.3 Vouchers

To redeem a voucher card or code at Matt & Elly AG, please send us your order by email to info@matt-elly.com and the voucher code so that we can redeem it. A voucher redemption via online store is unfortunately not possible.

9. INTANGIBLE ASSETS AND OTHER RIGHTS

Matt & Elly AG is the owner and operator of the online store matt-elly.com. All trademarks, names, titles, logos, images, designs, texts and other materials used on it belong to Matt & Elly AG. No rights (rights of use, intellectual property rights, etc.) are acquired by calling up, downloading or copying pages. The (complete or partial) reproduction, transmission (electronically or by other means), modification, linking or use of the portal for public or commercial purposes is prohibited without prior written consent.

11. GENERAL CONDITIONS

11.1 Severability clause

If any part of these GTC is found to be unenforceable or invalid for any reason, the validity of the remaining provisions shall not be affected.

11.2 Applicable law & place of jurisdiction

Swiss law is exclusively applicable. The place of jurisdiction is Basel-Stadt or the customer’s place of residence.

12. CHANGES & ADDITIONS

Matt & Elly AG expressly reserves the right to adapt the present General Terms and Conditions GTC to the circumstances at any time and to apply them immediately.
